Terms of Service

These terms govern your use of MailBlastr. Please read them carefully — by using the Service you agree to be bound by them.

1. Acceptance of terms

These Terms of Service ("Terms") are an agreement between you and MailBlastr ("MailBlastr", "we", "us") governing your access to and use of the MailBlastr website, API, dashboard, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

2. The Service

MailBlastr lets you send email from your own verified sending domain through MailBlastr's infrastructure, to recipient lists (audiences and contacts) you manage in MailBlastr, with features such as merge fields, scheduling, automations, campaigns, and delivery reporting. You are responsible for verifying ownership of the domains you send from and for the content you send.

3. Your account

You sign in using your email address or Google Sign-In. You are responsible for maintaining the security of your sign-in credentials and for all activity that occurs under your MailBlastr account. You must provide accurate information and promptly notify us of any unauthorized use. You must be at least 16 years old and legally able to enter into these Terms to use the Service.

4. Acceptable use

You agree not to use the Service to:
  • Send unsolicited bulk email (spam) or any message that violates applicable anti-spam laws.
  • Send recipients you have no lawful basis or permission to contact, or purchased and harvested lists.
  • Distribute malware, phishing, fraudulent, deceptive, or misleading content.
  • Harass, threaten, or harm others, or send unlawful, hateful, or infringing content.
  • Violate the intellectual property or privacy rights of others.
  • Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or to other accounts.
  • Exceed, circumvent, or interfere with sending limits or other safeguards.
We may suspend or terminate accounts that violate this section.

5. Email and anti-spam compliance

You are solely responsible for the content of your messages and for compliance with all laws that apply to your sending, including the CAN-SPAM Act, CASL, the GDPR and ePrivacy rules, and any other applicable regulations. This includes obtaining any required consent, identifying yourself accurately, honoring unsubscribe requests promptly, and including a valid physical mailing address where required. You confirm that you have the right to contact every recipient you send to through the Service.

6. Google sign-in

If you choose to sign in with Google, MailBlastr uses Google Sign-In only to authenticate you; it does not access Gmail, Google Sheets, or any other Google product. Your use of Google Sign-In remains subject to Google's own terms and policies. MailBlastr is not affiliated with, endorsed by, or sponsored by Google LLC. Google is a trademark of Google LLC.

7. Plans and billing

Some features require a paid plan. Fees, billing cycles, and what each plan includes are described at the time of purchase. Paid plans renew automatically until cancelled. You can cancel at any time from your account settings and will retain access through the end of the current billing period. Except where required by law or stated in our refund practices, fees are non-refundable. We may change our prices on prospective notice.

8. Intellectual property

The Service, including its software, design, and content we provide, is owned by MailBlastr and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain all rights to the content and data you create or upload; you grant us the limited rights needed to operate the Service for you.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any message will be delivered, opened, or reach the inbox, as delivery depends on factors outside our control.

10. Limitation of liability

To the maximum extent permitted by law, MailBlastr will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless MailBlastr from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, the content you send, or your violation of these Terms or of any law or third-party right.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing to provide the Service is no longer commercially reasonable. On termination, your right to use the Service ends, and we will handle your data as described in our Privacy Policy.

13. Governing law

These Terms are governed by the laws applicable in our principal place of business, without regard to conflict-of-law rules. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.

14. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after a change takes effect means you accept the revised Terms.
